Welcome to Project BLK (“Project BLK,” “PRJ BLK,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website, online store, and any related services (collectively, the “Site”), including any purchases you make from us.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility
By using this Site, you represent that:
You are at least 16 years old (or the age of majority in your jurisdiction), or you have permission from a parent/guardian.
You have the legal authority to enter into these Terms.
You are using the Site for personal, non-commercial purposes (unless we have agreed otherwise in writing).

We may update, modify, or replace these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes means you accept the updated Terms.
3. Account Registration
Some features of the Site may require you to create an account.
You agree to:

Notify us immediately of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
4. Products, Availability & Descriptions
We offer limited-run, luxury streetwear and accessories under the Project BLK brand.
We do our best to accurately describe products, including colors, sizing, materials, and details. However:
Actual colors may vary depending on your screen settings.
Small variations in fit, color, or design may occur between samples, mockups, and final production.
We reserve the right to limit quantities, discontinue products, or change product details at any time without notice.
We do not guarantee that any item shown on the Site will be in stock or available at all times.
5. Orders & Acceptance
When you place an order, you are making an offer to purchase the product(s) under these Terms.
We may accept or decline your order at our sole discretion, including if:
The product is out of stock.
There are errors in pricing or product information.
Payment cannot be processed or is flagged as fraudulent.
If we cancel an order after your payment has been processed, we will issue a refund to your original form of payment.
6. Pricing, Taxes & Payments
All prices on the Site are listed in U.S. dollars (USD) unless stated otherwise and are subject to change without notice.
You agree that:
Prices do not include applicable sales tax, customs duties, or shipping charges unless specified.
You are responsible for any taxes, duties, or fees imposed by your jurisdiction.
You will provide valid payment information and authorize us (or our third-party payment processor) to charge the full amount of your order, including shipping and taxes.
We use secure third-party payment processors. We do not store full payment card details on our servers.
7. Shipping & Delivery
We ship orders to the address provided at checkout. You are responsible for ensuring that your shipping information is correct.
Shipping costs and options will be displayed at checkout.
Estimated delivery times are provided for convenience and are not guaranteed.
Risk of loss passes to you upon our delivery of the order to the carrier.
We are not responsible for delays or delivery issues caused by carriers, customs, weather, or events beyond our control.
8. Returns, Exchanges & Refunds
Because Project BLK focuses on small-batch, limited drops and pre-sales, our return and exchange policy is intentionally strict to protect production and inventory.
Please read carefully before purchasing:
8.1 General Policy
We do not offer refunds to the original payment method except in limited situations such as confirmed defects or order errors on our part.
For eligible items, we may offer size exchanges or store credit only, subject to availability.
8.2 Return & Exchange Window – 7 Days
You must contact us within 7 days of the delivery date (as shown by the carrier’s tracking) to request an exchange or store-credit return.
Requests made after this 7-day window may be denied.
8.3 Condition of Items
To be eligible for an exchange or store credit, items must be:
Unworn and unwashed.
Free of odors, stains, pet hair, makeup, or damage.
In original condition with all tags, stickers, and packaging attached.
We reserve the right to refuse any return that does not meet these standards.
8.4 Final Sale Items
The following are final sale and are not eligible for return, exchange, or store credit (unless defective upon arrival):
All pre-sale / pre-order items, including pre-sale hats and pre-sale accessories.
Any item specifically marked “Final Sale” at checkout or on the product page.
Discounted or promotional items as stated on the Site.
Hats, beanies, and certain accessories for hygiene reasons (including non–pre-sale, unless otherwise stated).
8.5 Defective or Incorrect Items
If you receive a damaged, defective, or incorrect item:
Contact us within 7 days of delivery with your order number and clear photos of the issue.
If we confirm a defect or fulfillment error, we will, at our discretion, offer a replacement, repair, or store credit.
Normal wear and tear, loose threads, minor print/embroidery variations, or slight color differences are not considered defects.
8.6 Return Shipping Costs
Unless the return is due to our error, you are responsible for all return shipping costs.
We recommend using a trackable shipping service. We are not responsible for returns lost in transit.
8.7 Store Credit
Store credit will be issued via digital gift card or code usable only on our Site.
Store credit is non-transferable and cannot be redeemed for cash.
The full, most current version of our Return & Exchange Policy will always be available on the Site and is incorporated into these Terms by reference.
9. Pre-Sales & Pre-Orders
Project BLK frequently launches pre-sale collections, including early access drops and limited first releases.
By placing a pre-sale/pre-order, you acknowledge and agree to the following:
9.1 Payment Timing
Payment is collected at the time you place the pre-order, not at the time of shipment.
Your order is not reserved until payment is successfully processed and you receive an order confirmation email.
9.2 Pre-Sale Window & Weekly Drops
Pre-sale periods may run for a fixed window (for example, December 3–December 31, 2025, with new styles added weekly).
We reserve the right to open, close, or extend pre-sale windows at our discretion.
9.3 Production & Shipping Timeline
Pre-sale items are produced after the pre-sale window closes so we can manufacture based on real demand.
Estimated ship dates (for example, around an official launch date such as January 31, 2026) are guidance only and are not guaranteed.
Delays can occur due to production, customs, and logistics. We will make reasonable efforts to communicate any significant changes.
9.4 Final Sale – No Cancellations
All pre-sale and pre-order purchases are final sale.
This includes all pre-sale hats and pre-sale accessories, which are 100% final sale with no returns, exchanges, or store credit, except in the case of confirmed defects or fulfillment errors.
Once your order is placed, it cannot be canceled or changed (including size, color, or shipping address), except as required by law or where we cannot fulfill your order.
9.5 Limited Quantities & Design Adjustments
Pre-sale quantities may be capped. If demand exceeds capacity and we cannot fulfill your order, we may cancel your pre-order and issue a full refund.
Minor adjustments to design, color tone, or details may be made during final production for quality or manufacturing reasons. These will not change the overall character of the piece.
9.6 Early Access & Access Codes
Certain customers (such as members of our BLKLIST or early supporters) may receive early access links, passcodes, or exclusive discounts during pre-sale periods.
Access codes are personal, may be single-use, and can be revoked if misused, shared publicly, or used fraudulently.
9.7 Inability to Fulfill
If, due to factors beyond our control or manufacturing limitations, we are unable to produce and ship your pre-sale item:
We will notify you and provide a full refund to your original payment method.
We are not liable for any additional costs, losses, or damages arising from such cancellation.
10. Promotions, Discounts & Codes
From time to time, we may offer promo codes, discounts, or special offers (including member-only or pre-sale incentives).
Unless otherwise stated:
Promo codes are valid for one-time use and may not be combined with other offers.
Codes must be entered at checkout and cannot be applied retroactively.
Discounts may not apply to pre-sale items, final-sale pieces, or specific collections, as stated on the product or campaign page.
We reserve the right to modify or cancel promotions at any time.
11. Intellectual Property
All content on the Site—including logos, brand names (such as Project BLK and Break The Dress Code), graphics, text, photographs, videos, designs, and layouts—is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.
You agree that you will not:
Copy, reproduce, modify, distribute, or create derivative works of any content from the Site without our prior written permission.
Remove any copyright, trademark, or proprietary notices from the Site or products.
12. User Content & Social Media
If you tag us, use our hashtags, submit photos/reviews, or otherwise share content with us (“User Content”), you grant Project BLK a non-exclusive, worldwide, royalty-free, transferable license to:
Use, reproduce, modify, display, perform, and distribute that content on our Site, social media, and marketing materials.
You represent and warrant that:
You own or control the rights to the User Content.
The User Content does not violate any third-party rights, laws, or these Terms.
If you would like us to remove User Content featuring you, contact us at the email listed in the Contact Us section.
13. Prohibited Uses
You agree not to use the Site:
For any unlawful purpose.
To harass, threaten, abuse, or harm others.
To upload or transmit viruses, malware, or any harmful code.
To attempt to gain unauthorized access to our systems or interfere with the operation of the Site.
To scrape, crawl, or harvest data without our prior written consent.
We may restrict or terminate access to the Site for any user who violates these Terms.
14. Third-Party Services & Links

Defects will be corrected.

Any product will meet your expectations in every respect (including personal style preferences or fit).
16. Limitation of Liability
To the fullest extent permitted by law, Project BLK and its owners, employees, affiliates, and partners will not be liable for:

Any loss of profits, revenue, data, or goodwill.

18. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or relating to your use of the Site or our products will be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles.
Any dispute, claim, or controversy will be resolved:
First, through good-faith informal negotiations between you and us.
If not resolved, then through binding arbitration or in the courts located in Austin, Travis County, Texas, unless another forum is required by law.
You agree to the exclusive jurisdiction and venue of these courts/arbitration forums.
19. Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to the Site, your account, or your ability to make purchases at any time, without notice, for any reason, including violation of these Terms.
Upon termination, your right to use the Site will immediately cease, but any obligations or liabilities incurred prior to termination will survive.
